Short Term Rental Agreement for 8185 Fan Palm Way, Kissimmee, FL. 34747
General Terms: No person under the age of 25 is permitted to enter into this agreement unless previously approved. By acknowledging and agreeing to this rental agreement confirms the acceptance of the terms and conditions set forth and shall be binding on all the persons intending to occupy the property whether or not said persons have signed the booking form. It is understood that all persons have read and understood the terms and conditions as stated in the contract.
Rental Period and Occupancy: Check In time is 4pm EST local time on the day of arrival. Check Out time is 10am EST local time on the day of departure, unless previously arranged. Unauthorized early arrival or later departures will result in s $50 additional charge to card on file. The property may only be occupied by a maximum of 12 persons (children & adult) as per Florida Law. The accommodation is booked solely for persons named on the rental agreement and the owner or management company reserves the right to refuse entrance to any parties not so named. The property is only licensed for short term rental in the State of Florida. The legal names of all persons occupying the house, including ages and legal address, must be provided prior to arrival including young children and infants. It may on occasion be necessary for staff or agents of the owner or Management Company to enter the premises in order to perform routine maintenance or repairs.
Rental Payment: Initial 50% deposit of total booking is due upon reservation with balance payable 30 days prior to arrival. Reservations for an arrival within a 30-day window must be paid for in full at the time of booking, unless otherwise stated. If paying by credit card, your credit card will be charged at this time, together with the appropriate handling fee. If final payment is not received and no written notice given, your reservation may be canceled, and your deposit may be forfeited. No reservation is confirmed until the booking deposit is paid. If reservation is canceled in writing prior to 30 days of arrival all monies paid will be refunded 100%.
Security Deposit: IN ADDITION to the nightly rate and other applicable fees a refundable security deposit of ($250) will be charged unless otherwise agreed. This credit card will be charged to cover extra accommodation costs or loss or damage to the rental property in excess of normal wear and tear during the period of rental. Guests will be notified within 14 days of any charges made to the card. The property should be left clean and undamaged. If the property is not left in a suitable condition, it may be necessary to charge the security deposit for costs to cover extra cleaning or damage / repairs.
Liability Limitations: The owners and the management company of the property accept no responsibility whatsoever for the death, personal injury, accidents, loss, or damage to persons or personal property and/or personal belongings however caused. The use of all accommodations and all amenities, including the swimming pool, spa, and all other facilities is entirely at the user’s own risk. Children must be supervised at all times by responsible adults when using the swimming pool. When not in use the child safety net must be fastened in place for insurance / liability reasons. For safety reasons, glass is not permitted within the pool area. Please remove bobby pins from hair before entering the pool as they will cause rust stains on the pool floor if left unnoticed. The owners and the management company cannot accept any liability for any loss rental time due to travel problems, flight delays, cancellations, terrorist acts, industrial disputes, weather related events including hurricanes, any events outside our control, including any form of Force Majeure. The owners and Management cannot accept any liability for failure of public supplies / Utilities such as water, gas supplies, electricity, phone service, internet service, cable TV service, gas supplies or pool heaters. Nor do we accept liability for the consequences of the actions or omissions of others that may supply or control main services, or any actions taken in the vicinity of the property by any authority over which there is no control. The owner / management company accept no responsibility for and shall not be liable in respect of loss / damage / cancellation or changes caused by unforeseen major events, such as but not limited to, strikes, floods, fires, airport closure etc, or any other event beyond their control.
Smoking: Smoking is NOT permitted. I agree not to engage in or allow smoking of any substance inside the home. If smoke is detected during or after stay, there is a penalty of $200 to be automatically charged to my card on file for every instance.
Unlawful and Uncivil Activities: Everyone in my party staying in the home allotted to me promises to abide by all rules and laws, local, state or federal. I will be solely responsible for any such activity and the management does not bear any responsibility in any such incident. I understand that any disturbance caused by my party or valid complaints from my neighbors may cause me to be evicted without recourse and a forfeit of rent and deposit.
Quiet Time: 10:00 pm to 7:00 am. Please respect these hours for everyone in the neighborhood's enjoyment.
Accommodations: I understand this home is privately owned and reflects the owner's individual tastes and requirements. I agree not to remove furnishings, kitchen appliances, utensils or any linen in any circumstance. I agree to pay a penalty of 125% of the replacement cost for any stolen article.
Pool Heating: Both pool and spa heating are available for an additional fee. For safety reasons, glass is not permitted within the pool area. The pool heater and spa heater are set and locked to a standard safe bathing temperature (90 degrees for pool & 103 for spa). The pool heater is set to operate at set hours during the day from 8am-5pm to reach the optimum benefit from the pool heating at normal times and that the system complies with the operating requirements as laid down by the manufacturers. Minimum 5 consecutive days is recommended for pool heat late October through April. Pool heat runs from 10am-6pm. Spa heat operates when activated by command only and runs for 60 minutes per command. Pool and Spa heating are available for an additional $25 per day. Only guests that have paid for pool/ spa heat will have the benefit of this facility. Any guest found tampering with the equipment will forfeit their entire security deposit. As the heaters can only operate effectively when the outside air temperature reaches above 55 degrees, for a majority of the time that the timer is set for and is dependent on this fact, neither the homeowner nor the management company can be held responsible for the ambient temperature of prevailing weather conditions. The actual water temperature will vary with the ambient temperature, time of use and weather conditions.
Agent / Management Company: Preferred Vacation Home is the property management company in the area. They take care of inspection services, maintenance issues, cleaning, pool maintenance / upkeep pest control, and other needs or issues you may have while staying in our home. Cancellation: All cancellations must be received in writing and confirmed. In the event a guest cancels a Reservation, resulting cancellation charges will be as follows. Greater than 30 days prior to check in date all monies will be refunded. Cancelations received in writing within 30-14 days will receive a 50% refund. Cancelations fewer than 14 days prior to check in will forfeit 100% of all monies paid to date.
Governing Law: All reservation of the resort accommodation and the use and occupancy of such accommodations shall be governed by the laws of the State of Florida. All disputes between owners and renters shall be subject to the exclusive subject matter and personal jurisdiction of the courts in the state of Florida. In the event of litigation between renters and owners, the prevailing party shall be entitled to all costs incurred, including attorney’s fees.
